聘请外国籍教师合同
一、兰州交通大学兹聘请籍 (外文姓名) (译名)女士(先生)为外国籍教师/外国籍专家。双方本着友好合作精神,自愿签订本合同并保证认真履行合同中约定的各项义务 。
二、合同期自年月 日起至 年月 日止。
三、受聘方的月薪为人民币(大写) 元,其中30%/70%可按月兑换外汇。 薪金自到职之日起至合同期满之日止,按月发给。不足整月的按日计发。日薪为月薪的三十分之一(二月份同)。
四、聘方的义务:
1、向受聘方介绍中国有关法律、法规和聘方有关工作制度以及有关外国专家的管理规定。
2、对受聘方的工作进行指导、检查和评估。
3、向受聘方提供必要的工作和生活条件:一套装配齐全的免费住房:配有卧室、卫生间、厨房、计算机、打印机、电视机、洗衣机、微波炉、电冰箱、VCD播放机、取暖和降温设备等。向受聘方提供互联网联接。
4、配备合作共事人员。
5、按时支付受聘方的报酬 。
6、受聘方享受外国籍教师/外国籍专家待遇的,合同期为一年(一学年), 聘方为其提供一次离华/一次往返捷径中国民航航班经济仓国际机票和中国境内火车交通费用 ( ——之间)。
7、按中国的医疗制度为受聘方提供公费医疗。但是,挂号、出诊、就医交通、镶牙、洗牙、整容、按摩、配眼镜、住院用餐和服用非医疗性的滋补药品等费用自理。
在合同期内,受聘方在*、香港、澳门地区和中国*的医疗费用自理。
8、聘方为受聘方担负居留证办理费用。
五、受聘方的义务:
1、遵守中国的法律、法规,不干预中国的内部事务。
2、尊重中国的文化、宗教政策,尊重中国人民的道德规范和风俗习惯,不从事与专家身份不符的活动。
3、遵守聘方的工作制度和有关外国专家的管理规定, 接受聘方的工作安排、业务指导、检查和评估。
4、受聘方每周上课 14-16 学时。
5、在聘期内, 受聘方必须按期完成所分配的教学任务及有关的工作任务,保证工作质量。
6、未经聘方同意,受聘方不得兼任与聘方无关的其他任何劳务,否则聘方有权要求受聘方以违犯合同论处。
7、除日常考查外, 受聘方应在学校规定的时间对所任班级学生进行期中、期末考试, 并在考试后四天内将成绩上报有关任教单位。
8、受聘方应遵守学校对教学工作的有关规定,并接受学校有关部门人员的听课检查和评估。受聘方应不断改进教学方法提高教学质量。
9、受聘方应积极组织指导如英语角、播放录像、举办讲座这样的课外活动,平均每周一小时。
10、遵守住宿规定(见附件),离开本校外出住宿必须提前告知聘方;不允许留宿他人。
11、受聘方应对其聘期内个人安全和由此可能出现的医疗费用负全部责任。
12、受聘方受雇聘方时,其护照签证、体格检查、居留证延期、出入境签证费、护照身份转换费及保险等费用,均由受聘方担负。
13、若受聘方拥有机动车辆,须向聘方提供驾驶执照、保险等相关文件和证明材料,受聘方对可能出现的任何意外伤害、事故负全部责任。
六、休假
1、受聘方在教育部门任职,合同期为一学年,按所在学校的寒暑假和学校安排的假日休息。
2、受聘方可享受其本国以下节假日休假:圣诞节两天、国庆节一天、新年一天。受聘*要求过本国重大节日,可休假一天。但受聘方不得在学校规定的工作时间里以任何理由提出请假,或要求回国度假。
3、旅游补助费
受聘方享受外国籍教师/外国籍专家待遇的,合同期为一学年,完成合同约定的工作任务,聘方发给人民币 1400 元旅游补助费。合同期为一学期,完成合同约定的工作任务,聘方发给50%旅游补助费,旅游补助费不能兑换外汇。
4、受聘方请病假,应当凭医生证明。病假在30天以内的,薪金照发。30天后,若聘方未解除合同,可按受聘方月薪的50%支付薪金,直至恢复正常为止。30天后,若聘方解除合同,可酌情支付部分离华费用。
5、受聘方请事假须经聘方同意,然后按日扣发薪金。在合同期一年(一学年)内,事假累计不得超过十天。连续事假不得超过三天。未经聘方同意而擅离职守,旷职一天,扣发三天薪金。
七、合同的变更、解除和终止:
l、双方应信守合同,未经双方一致同意,任何一方不得擅自更改、解除和终止合同。
2、经当事人双方协商同意后,可以变更、解除和终止合同。在未达成一致意见前,仍应当严格履行合同。
3、聘方在下述条件下,有权以书面形式通知受聘方解除合同:
(1)受聘方不履行合同或者履行合同义务不符合约定条件,经聘方指出后,仍不改正的;
(2)根据医生诊断,受聘方在病假连续30天后不能恢复正常工作的。可酌情支付部分离华费用(不超过月工资的百分之三十)。
4、受聘方在下述情况下,有权以书面形式通知聘方解除合同:
(1)聘方未按合同约定提供受聘方必要的工作和生活条件;
(2)聘方未按时支付受聘方报酬。
八、违约金:
当事人一方不履行合同或者履行合同义务不符合约定条件,即违反合同时,应当向另一方支付 500—2000美元(或相当数额的人民币)的违约金。
受聘方因不可抗力事件要求解除合同,需出具有关机构证明,经聘方同意后,离华的费用自理;受聘*无故解除合同,除离华费用自理外,还应当向聘方支付违约金。

九、本合同附件为合同不可分割的一部分, 与合同具有同等效力。
十、本合同自双方签字之日起生效,合同期满即自行失效。当事人一方要求签订新合同,必须在本合同期满90天前向另一方提 出,经双方协商同意后签订新合同。
受聘方合同期满后,在华逗留期间的一切费用自理。
十一、仲裁
当事人双方发生合同纠纷时,尽可能通过协商或者调解解决。若协商、调解无效,可向国家外国专家局设立的外国文教专家事务仲裁机构申请仲裁。

15th building Guesthouse Regulations
International Cooperation & Exchange Office
We would like to warmly welcome you to the Lanzhou Railway University. In order to make your stay more pleasant, we have taken pains to provide you with accommodations and furniture possible. We would, however, like to remind you of the following points concerning the school regulations and facilities.
1.Please take good care of the appliances and household items provided for you. You will be held responsible for any loss or damage to the items in your flat.
2.To assist you in your teaching work, we have provided you with the latest computer technology. Please use computer and its peripherals carefully. Improper use can cause damage to sophisticated peripherals. In this case please contact the relevant persons on priority basis and you will be responsible for the replacement of the damaged peripherals.
3.Please do not use electrical appliance above capacity on the existing line. Do not use two or more electrical appliances over 1000 output simultaneously, such as electromagnetic cooker, shower, Yuba and electrical heating except for those extremely necessary at peak hours (normally evening).
4.Cooking electricity board has high voltage for cooking appliances. Pay more attention to your safety while plugging in the devices. Make sure to turn off the electricity after cooking.
5.Please make sure about your safety while having shower. You are strongly required to turn off the electric geyser (Boiler) before having shower.
6.Guests are not permitted to link wires without the permission of the International Cooperation & Exchange Office .
7.Please do not throw anything (Toilet papers, Plastic items etc) into flush (WC) that could result in sewerage blockage. In case of blockage contact the caretaker.
8.Please do not keep the guests to stay overnight. Do not let any of your students or any irrelevant person copy your apartment keys.
9.Please pay your telephone bills on time every month. You have got two telephone lines in your apartment. One is to place local calls as well as inside campus calls, for which you have to pay the bill every month from 5th to 15th at communication center, while the other one is IP phone to place long distance and international calls.
10.Please do not smoke in bed.
11.Please notify the International Cooperation & Exchange Office if you plan to leave the guesthouse overnight. Do lock both doors and all of the windows properly when leaving the flat, and also make sure to turn off all faucets and switch off all the electric appliances in the flat.
12.Please ensure that your flat is kept reasonably clean.
13.Whenever possible, please endeavor to conserve electricity and water.
14.Rarely the university is subjected to uncontrollable power outages and water shortages. In the event of such an occurrence, the International Cooperation & Exchange Office will do its best to provide help and information, but please remember that such actions are often taken without the consent off the university and are difficult to anticipate.
